This Applicant Privacy Notice explains how Foley.io collects, uses, stores, and shares personal information about job applicants and candidates.

We may collect voluntary demographic information such as:

  • Race/ethnicity

  • Veteran status

  • Disability status

Providing this information is optional, and it is not used in hiring decisions.

 

Information Collected Automatically Through Ashby ATS

 When you apply online, our Applicant Tracking System (Ashby) may automatically collect:
  • IP address

  • Browser information

  • Device details

  • Usage data related to the application portal

Because Ashby is a third party service provider, your use of that site or service may also be subject to the provider’s own terms and privacy notice. We are not responsible for the privacy practices of those providers in connection with information they collect and use for their own independent purposes.

Typically, we retain applicant data for 1–3 years, depending on state requirements and litigation risk. If you are hired, your data becomes part of your personnel file.

  • A written authorization form

  • Any applicable state-specific notices

We use a third‑party background check provider to obtain background reports on applicants and candidates where permitted by applicable law and appropriate for the role. That provider collects and processes your personal information in accordance with its own terms and privacy notice.

If any adverse action is taken based on a background check, you may receive:

  • A pre-adverse action notice

  • A copy of the report

  • A summary of your rights under FCRA


Security Measures

We implement administrative, technical, and physical safeguards designed to protect personal information, including:

  • Encryption

  • Secure cloud hosting

  • Limited personnel access
