FMCSA Upgrades Clearinghouse Security: What CDL Employers Need to Know
3:44

The FMCSA Drug and Alcohol Clearinghouse is getting a major identity verification overhaul. Here's what's changing, who it affects, and how Foley keeps you ahead of it.

What's Changing with Clearinghouse Security?

The Federal Motor Carrier Safety Administration announced new identity verification requirements for several categories of Clearinghouse users to achieve stronger fraud prevention, improved record accuracy, and greater accountability across the database's six million users.

FMCSA Administrator Derek Barrs put it plainly: the agency is focused on "closing gaps that could be exploited by bad actors" and "protecting the integrity of the data."

The new verification process will be powered by IDEMIA, the same identity verification technology used by the Department of Homeland Security at airports across the country. This change signals that the federal government is treating Clearinghouse data security with the same seriousness as airport security screening.

Who is Required to Comply with the New Clearinghouse Security Measures?

The new identity verification requirements apply to:

  • Medical Review Officers (MROs)
  • Substance Abuse Professionals (SAPs)
  • Third-Party Administrators (TPAs)
  • Employers of CDL Drivers

CDL holders are not included in this initial phase since they're already verified through state licensing systems; however, future phases may extend these requirements to other Clearinghouse users.

If your company uses the Clearinghouse, whether you're running pre-employment queries, reporting drug or substance use violations, or managing the DOT return-to-duty process, this change affects you.

How to Stay Compliant Amidst the Clearinghouse Security Changes

Whether you're a large national carrier or an owner-operator with a handful of trucks, keeping up with ever-changing Clearinghouse requirements can feel like a full-time job on its own. That's exactly where Foley comes in.

Foley helps transportation companies of all sizes navigate the evolving compliance landscape. From pre-employment screening and Clearinghouse queries to full-service C/TPA support, Foley handles the complex compliance requirements so you don't have to.

Here's how Foley helps you stay on the right side of federal requirements, like these new ID verification rules:

Full-Service TPA Support: We can help manage key Clearinghouse responsibilities on your behalf once Foley is authorized as your C/TPA, and stay current on changes like these, so you don't have to scramble every time the FMCSA updates its requirements.

Proactive Compliance Alerts: Regulatory changes don't come with much warning. Foley monitors FMCSA updates and translates them into specific action items for your team, so nothing falls through the cracks.

Pre-Employment Query Management: Every CDL hire requires a Clearinghouse query before they get behind the wheel. Foley manages that process seamlessly, integrating it into your broader onboarding workflow.

Scalable Solutions for Any Fleet Size: Whether you're managing five drivers or 5,000, Foley's compliance solutions scale with you. Small fleets get the same depth of expertise as enterprise carriers without the enterprise overhead.

Ongoing Monitoring: The Clearinghouse isn't just a pre-hire checkbox. Annual queries are required for current employees, and violation-related follow-ups have their own timelines. Foley keeps track of all queries, so you don't miss a critical deadline.
