Current FMCSA Fine Levels for Hours of Service Violations
FMCSA can issue civil penalties when Hours of Service rules are broken. Penalties vary by the type of violation and who is responsible. For 2025 and into 2026 the maximum civil penalties for HOS-related violations include:

Carriers can face fines of up to around $19,000 per violation for basic Hours of Service violations.

Drivers can face fines of up to about $4,800 per violation when they fail to meet HOS rules
-
More serious violations such as log falsification or knowingly filing false records can bring civil penalties of about $15,800 or more.
These penalties are civil fines set by FMCSA and reflect the agency’s effort to enforce compliance. Accurate logkeeping and correct ELD use help reduce the likelihood of large fines during Roadcheck 2026 and beyond.
